Can an individual or hedge fund buy more shares after announcing they plan to buy a company out.

I was wondering about this. Does anyone know if it is legal, in the case of Twitter, for an individual like Elon Musk to buy more shares of Twitter now at the current price so he doesn't have to pay for those shares at the buyout price he offered?
